PGLU Approves Fine Sharing Ordinance

The Sangguniang Panlalawigan of La Union passed an Act Providing for the Sharing of Fines of Collected Monetary Penalties in the Violation of Provincial Ordinances on January 19, 2021.
The sharing of collected monetary fines from penalties of violators of provincial ordinances would further impart the value of sharing of responsibility in the implementation of ordinances by Local Government Units as well as the apprehending entities and further use of said share for strengthening their capabilities in securing the safety and security of the people.
Board Member Nancy Corazon Bacurnay, the primary author of the ordinance said it was an effort of the Provincial Government of La Union (PGLU) to strengthen its capability of implementing various ordinances of the province in hopes that it would create a safer and secured community throughout the province.
Under section 2 of the ordinance says that fines paid by violators through the Provincial Ordinance Violation Receipt shall be shared by the Apprehending Authority (i.e. La Union Police Provincial Office, City/Municipal Police Stations, Highway Patrol Group or other Philippine National Police Support Units) deputized officers pursuant to the Provincial Ordinance Violation Receipts as apprehending authorities-30%; Component Municipality/City where the apprehension was made-20%; Barangay where the apprehension was made-10%; PGLU (shall accrue to the General Fund)- 40%.
The Provincial Treasurer is directed to remit to the Municipal/City Treasurers and Barangay Treasurers on or before the 15th day of the following month the shares of the barangay, municipal or city on the fines collected. The share on the apprehending offices under the PNP shall be withheld on their accounts as future basis of the PGLU in part or in full, in providing support for their identified programs and projects.
The sharing of Fines Ordinances will take effect 15 days after its publication in newspaper of general circulation.
