The Sangguniang Panlalawigan (SP) of the Province of La Union convincingly voted during its regular session to pass a resolution opposing the Re-Imposition of the Death Penalty, with ten voting for the opposition on the Death Penalty and two in favor of the imposition.
Hon. Jennifer C. Mosuela-Fernandez conveyed to the August Body the proposal of the House of Congress on the re-imposition of the death penalty and that she proposed that the August Body will come up with one stand in opposing the Re-imposition of the Death Penalty taking into account, the issue and factors involved.
After considering the standpoint of all Board Members, a majority or 10 BMs stood and voted in opposing the House bill on the re-imposition of the death penalty, they are Hon. Maria Rosario Eufrosina P. Nisce, Hon. Geraldine Joy R. Ortega, Hon. Gerard G. Ostrea Hon. Jennifer C. Mosuela-Fernandez, Hon. Rachel N. Pinzon Hon. Cynthia Angelica M. Bacurnay Hon. Henry B. Balbin, Jr.,Hon. Pablo C. Ortega Hon. Geraldine R. Ortega and Hon. Alyssa Kristine B. Sibuma, save for Board Members Ma. Annabelle S. De Guzman, and Victor I. Rivera, who favored the imposition of the inhumane capital punishment. The two legislators favored the measure because in their opinion the imposition will prevent the commission of a heinous crime and due to the rise or increase in rape- slay cases, drug trafficking, and other heinous offenses in the country and the imposition thereof would lower the crime rate and that criminals would think twice before committing a heinous crime.
Board Member Jennifer Mosuela-Fernandez, who chairs the SP Committee on Laws, Rules and Privileges, pointed out that the imposition of the capital punishment violates Internationally accepted standards and principles such as the second protocol, which expressly prohibits state executions as ratified by Congress on November 20, 2007 provides the country can no longer withdraw from its international commitment as stipulated in the Vienna Convention on the law of treaties. And treaties such as this one shall form part of the law of the country.
Further, if the real intention of the legislators is to lessen or eradicate the heinous crime then focus should be directed on strengthening the justice system and efficiently enforce the ordinance on the curfew of minors, and implement the ordinance on the installation of CCTVs because in a way it could aid in solving the crime. Let there be police visibility in every area of concern to deter criminals, she added.
Copies of the said approved resolution shall be forwarded to President Ferdinand R. Marcos Jr., Senate President Juan Miguel Zubiri and all Senators, Senate of the Philippines, Hon. Martin Romualdez, Speaker, House of Representatives, Congressman Francisco Paolo P. Ortega V, Congressman Dante S. Garcia from the first and second district, respectively of the Province of La Union.
